Terms of Service
These terms cover how Prefire works for backers (people who pay) and creators (people who sell). Last updated October 21, 2026.
1. About Prefire
Prefire (prefirehq.com), operated by [LEGAL ENTITY NAME], is a platform that lets creators collect payment from their audience before they make an item, to find out whether enough people want it. By using Prefire you agree to these terms, our Refund Policy, our Fees page and our Privacy Policy. If you don't agree, don't use Prefire. You must be 18 or older and, for now, located in the United States.
2. What Prefire is, and is not
The creator is the seller of every item. Prefire provides the storefront, takes payment, holds it, and releases it under the rules below. Prefire is not the seller, manufacturer or shipper of any item and is not a party to the sale between a backer and a creator.
A payment on Prefire is a purchase of an item from a creator, to be delivered later. It is not an investment, a loan, a donation, or a purchase of equity or profits.
3. For backers
- What you pay. The item price, shipping, and a service fee (a percentage of the item price plus shipping, and a flat amount per item). The total is shown before you pay and nothing else is added later. Sales tax, where it applies, is shown at checkout.
- Your money is held. We hold your payment until the creator submits shipping proof that we verify, or until a refund happens under the rules below. By paying, you agree to let it be held until the ship-by date shown on the item page.
- Automatic refunds. If the creator has not shipped by that date, you are refunded automatically (item price and shipping). A creator may be given one extension of about two weeks. While an extension runs you can ask for a refund at any time, and if the item still hasn't shipped by the new date you are refunded automatically. If a creator cancels, you are refunded.
- The service fee is non-refundable in every case, including when an item never ships.
- Buying more than one item. The first item pays full shipping and each additional item from the same creator pays less, because they ship together in one package. When refunds are open to you (see the Refund Policy), you can refund items one at a time. A refunded item returns its share of the item price, shipping and tax, but never the service fee.
- Delivery. Once an item ships, delivery, quality and fit for purpose are between you and the creator. We will help where we reasonably can, but we don't guarantee that an item will meet your expectations.
- Before disputing a charge, please contact us at support@prefirehq.com so we can fix it quickly.
The full details are in the Refund Policy.
4. For creators
- Your account. You must complete Stripe's identity and bank verification to be paid, and you agree to Stripe's terms. You are responsible for your account and everything done through it.
- Your listings. Descriptions, photos, prices, sizes, shipping regions and dates must be accurate. You choose the ship-by date, up to 120 days, and backers rely on it.
- Fulfilling orders. You are responsible for making, packing and shipping every item you sell, and for funding production yourself. You are paid only after you ship and we verify your tracking numbers. If you don't submit shipping proof by your deadline, every backer is refunded automatically.
- Shipping. Backers pay the shipping price you set, and it is paid to you less the service fee percentage, which applies to item price plus shipping. If real postage ends up higher, you cover the difference. Shipping estimates we suggest are only suggestions.
- Combined shipping. You set a price for the first item and a lower price for each additional item. When a backer buys more than one item from you in one checkout, they pay that combined price, and you must pack those items in one package and submit one tracking number for it. Items that ship from different locations, or whose ship-by dates are far apart, may be sent separately. Do not charge more for shipping than you set, and do not hold combined items back to ship them separately.
- Extensions. You may ask once, before your deadline, for a short extension by showing that your order is really in progress. We decide whether to approve it.
- Fees. You pay $5 per month to keep your page live, plus the creator fee on each sale described on the Fees page. We deduct fees from your payout.
- Refunds and disputes. If a payment is refunded or charged back, we may take that amount from your payout or balance, or recover it from you.
- Taxes. You are responsible for your own income taxes. We may collect and remit sales tax on sales where the law requires us to, and we may require tax information from you and report your earnings as the law requires.
5. What you can't sell or do
No counterfeit or infringing goods, illegal or regulated items, adult content, weapons, or anything that breaks the law. No misleading listings, no collecting money for items you don't intend to deliver, no fraud, no abuse of other users, and no attempts to get around our fees or hold rules. We may remove listings, refund backers, hold funds, or suspend accounts that break these rules or that we reasonably think put users at risk.
Comments
Signed-in users can comment under items. Comments are filtered and monitored. We block hateful, threatening, harassing and spammy messages, including attempts to disguise them, and we may hide any comment and pause or end an account that breaks these rules. Links and ads are not allowed in comments from backers. A comment written by the item's creator is shown with a Creator badge. Please don't share personal details such as addresses or phone numbers in a comment. Comments are public. Blocked and hidden comments are kept for our records and to protect users.
6. Your content
Creators keep ownership of the photos, text and other content they upload. You give us a license to host, display and promote it in connection with Prefire. You promise that you have the right to use it and that it doesn't infringe anyone's rights.
7. Third-party services
Payments are processed by Stripe, sign-in is handled by Clerk, and other providers help us run Prefire. Their terms apply to their services, and we aren't responsible for them.
8. Disclaimers and limits on liability
Prefire is provided "as is" and "as available". To the extent the law allows, we are not liable for indirect or consequential losses, for the acts of creators or backers, or for items that arrive late, damaged or not at all. Our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim, or $100 if greater. Some places don't allow some of these limits, so they may not apply to you. [Lawyer: review limits, indemnity and any arbitration or class-action terms.]
You agree to cover losses we suffer because of your content, your listings, or your breach of these terms.
9. Ending your access
You can stop using Prefire at any time, but obligations to existing orders continue until they are fulfilled or refunded. We can suspend or end access if you break these terms or if we need to protect users or comply with the law.
10. Changes, law, and contact
We may update these terms. Material changes will be posted here with a new date, and apply to future orders. These terms are governed by the laws of [STATE], and disputes will be handled in [COURTS / VENUE].
